1. About this Policy
Balnz (‘Balnz’) makes it a point of honour to respect the privacy of the persons whose personal data it processes (children, parents, etc. ) and to process such data in the strictest confidence and in accordance with applicable legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (the ‘General Data Protection Regulation’ or ‘GDPR’) and the Belgian Act of 30 July 2018 on the protection of individuals with regard to the processing of personal data (together, the ‘Act’).
This privacy policy (the ‘Policy’) is intended to inform users aged 13 and over (‘You’ or ‘You’) in a transparent manner when using the Balnz app, about the data that Balnz collects, the purpose of the collection, how Balnz uses the data and the rights that can be exercised regarding the processing of this personal data.
1. If the User is over 13 years of age, he or she will be able to access the Balnz application directly from his or her smartphone and consent to the processing of his or her personal data in accordance with the RGPD and the Privacy Policy addressed to him or her, which is available on the Balnz website.
2. If the User is under 13 years of age, he or she alone cannot consent to the processing of his or her personal data in accordance with the GDPR. In order to access the Balnz application, only a parent or legal guardian of the User may consent to the processing of the User's personal data by Balnz.
2. Person responsible for processing your personal data
Balnz is responsible for processing your personal data when you use the Balnz application:

3. Personal data collected
Balnz processes the following personal data about you:

Your telephone number ;

Your date of birth ;

Your gender;
-
Your questions, comments and/or opinions in the dedicated sections of the Balnz application;

Your activity time on your smartphone;

Your results in the Balnz application and rewards and ;

If your parents have registered you for the Balnz application, your parents' contact details.
Apart from these types of data, Balnz does not collect or store any other personal data about you. Balnz processes the time you spend on your smartphone, but Balnz does not collect any information about the content you view or your communications during this time. This means that Balnz is at no time able to see what you are doing and/or with whom you are communicating during your activity on your smartphone, the websites or social networks you visit, etc.

4. Why Balnz processes your personal data and why
Balnz collects and processes your personal data in order to:

Ensure your registration to the Balnz application;

Guarantee your access to the Balnz application;

Suggest challenges to manage your activity time on your smartphone;

Collect your activity time on your smartphone;

Give you rewards when you win challenges suggested by the Balnz application;

Answer your requests and/or questions;

Allow you to share your results with the Balnz community;

Ensure compliance with legal obligations imposed on Balnz;

To improve the Balnz application;

Pursue the legitimate interests of Balnz insofar as they are consistent with your interests, freedoms and fundamental rights.
The processing of your personal data is justified by:

Compliance with a legal obligation to which Balnz is subject;

Balnz's legitimate interests in processing your personal data, unless these override your interests or fundamental rights and freedoms.
5. How long we keep your personal data
Balnz will only keep your personal data for as long as is necessary for the purposes set out above. In certain cases, Balnz may continue to retain your personal data, for example to answer your questions and requests, to respond to your complaints or to ensure that Balnz complies with its legal obligations.
In order to improve the Balnz application, Balnz may also compile statistics based on your personal data. To do this, however, Balnz will make sure to anonymize your personal data beforehand, so that you can no longer be identified in the statistics produced.

6. Your rights
As provided for by law, you have the right to ask Balnz :

7. Sharing your personal data with other organisations
Balnz considers your personal data to be confidential information. Balnz will therefore not share your personal data with third parties unless this is provided for in this Policy and is wholly necessary for the purposes set out above or is required by law.
8. Transfer of your personal data outside the European Union
Balnz does not transfer your personal data outside the European Union.
Should such a transfer be strictly necessary, Balnz undertakes to verify that the country receiving your personal data ensures an adequate level of protection of your personal data in accordance with the Law.
9. Security of your personal data
Balnz takes appropriate security measures to guarantee a good level of security of your data in the Balnz application, for example to prevent:
unauthorised access to your data

10. Updates to the Policy
Balnz may need to modify and adapt this Policy, for example to comply with any new law applicable to the processing of personal data. In this case, Balnz will inform you and/or your parents of any changes so that you can read them.
