1. About this Policy
Balnz ("Balnz") is committed to respecting the privacy of individuals whose personal data it processes (children, parents, etc.) and to handling this data with the utmost confidentiality and in compliance with applicable laws, including Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the "General Data Protection Regulation" or "GDPR"), as well as the Belgian law of July 30, 2018 on the protection of individuals with regard to the processing of personal data.
This Privacy Policy (the "Policy") aims to transparently inform parents and legal guardians ("You" and "Your") of teenagers using the Balnz application ("Your Teen") about the personal data Balnz collects, the purposes of the collection, how Balnz uses Your personal data, and the rights You can exercise regarding the processing of Your personal data.
A separate privacy policy for teenagers is available here to inform Your Teen about the processing of their personal data by Balnz when using the Balnz application.
2. Data Controller of Your Personal Data
Balnz is the data controller of Your personal data when You use the Balnz application:

3. Personal Data Collected
Balnz processes Your personal data when (i) You use the Balnz application for Your own account and/or (ii) You register Your Teen to use the Balnz application.
When You authorize Your Teen to use the Balnz application and they are over 13 years of age, they can directly access the Balnz application from their smartphone and provide consent for the processing of their personal data in accordance with the GDPR and the separate privacy policy for teenagers available here.
When You authorize Your Teen to use the Balnz application and they are under 13 years of age, they cannot independently consent to the processing of their personal data as per the GDPR. In order for them to access the Balnz application, You, as the parent or legal guardian, must provide consent for the processing of Your Teen’s personal data by Balnz. Without Your consent, Your Teen will not be able to use the Balnz application.
When You use the Balnz application for Your own account and/or register Your Teen, Balnz processes the following personal data about You:

Your first and last name;

Only when using the application for Your own account: Your username;

Your phone number;

Your date of birth;

Your gender;

Only when using the application for Your own account: Your questions, comments, and/or feedback in the app’s dedicated sections;

Only when using the application for Your own account: Your activity time within the app;

Only when using the application for Your own account: Your profile picture or avatar;

Only when using the application for Your own account: Your results and rewards within the app;

Only when using the application for Your own account: Your interests and preferences;

Only when using the application for Your own account: Your friends who also use the Balnz application;

When You authorize Your Teen to use the application: Information about Your Teen.

4. Purposes of Processing and Legal Bases
When You use the Balnz application for Your own account, Balnz processes Your personal data for the following purposes:

Managing Your registration in the Balnz application;

Ensuring Your access to the Balnz application;

Suggesting challenges to help You manage Your screen time;

Recording Your screen time on Your smartphone;
-
Awarding rewards when You win challenges within the application;
-
Responding to Your questions and/or requests;
-
Enabling You to share and communicate within the Balnz community (e.g., Your results);

Complying with legal obligations applicable to Balnz;
-
Improving the application and services provided by Balnz;
-
Pursuing Balnz’s legitimate interests, provided they align with and do not infringe upon Your fundamental rights and freedoms.
When You authorize Your Teen to use the application, Balnz processes Your data to register Your Teen and ensure their access to the application. Once registered, Balnz processes Your Teen’s data as outlined in the separate privacy policy for teenagers available here.
The legal bases for processing Your personal data are:

Compliance with a legal obligation applicable to Balnz;

Balnz’s legitimate interests, provided they do not override Your fundamental rights and freedoms.
For Teens under 13 years of age, the processing of their personal data is based on Your parental consent, in accordance with Article 8 of the GDPR.
5. Retention Period of Your Personal Data
Balnz retains Your personal data and that of Your Teen only for as long as necessary for the purposes described above and in the separate privacy policy for teenagers. In some cases, Balnz may retain Your personal data and that of Your Teen, for example, to respond to Your inquiries, address complaints, or comply with legal obligations.
To improve the Balnz application, Balnz may compile statistics using Your data and that of Your Teen. In such cases, Balnz ensures that the data is anonymized so that neither You nor Your Teen can be identified.

6. Your Rights Regarding the Processing of Your and Your Teen’s Data
In accordance with the GDPR, You have the following rights:

To be informed about the purposes of data processing and the identity of the data controller;

To access Your personal data and that of Your Teen at any time;

To rectify inaccurate or incomplete personal data;

To object to the processing of Your or Your Teen’s data. Balnz may, in certain cases, be required to refuse this request if legally obligated;

To request the deletion of Your personal data and that of Your Teen. Balnz may, in certain cases, be required to refuse this request if legally obligated;

To request the restriction of processing under specific circumstances;

To request data portability;

To lodge a complaint with the Belgian Data Protection Authority online at www.dataprotectionauthority.be or via email: contact@apd-gba.be.

Balnz will process Your request as soon as possible, and at the latest within one month of receipt. This period may be extended by two months depending on the complexity and number of requests.
7. Disclosure of Your and Your Teen’s Data to Third Parties
Balnz considers Your personal data as confidential information and does not share it with third parties except as provided in this Policy, or when required by law, or when strictly necessary to achieve the purposes mentioned above.
8. Transfer of Personal Data Outside the European Union
Your data and that of Your Teen will not be transferred to countries outside the European Economic Area unless strictly necessary and provided that such countries offer an adequate level of protection within the meaning of the GDPR (more info: https://goo.gl/1eWt1V), or through appropriate contractual safeguards.
9. Security of Your and Your Teen’s Data
Balnz has implemented appropriate organizational and technical security measures to ensure a level of security appropriate to the risk and to prevent, as much as possible:

Unauthorized access or modification of data;

Improper use or disclosure of data;

Unlawful destruction or accidental loss of data.
Balnz staff members who have access to this data are bound by a strict confidentiality obligation.
10. Updates to this Policy
Balnz may amend or update this Policy to comply with any new applicable legislation and/or regulations, recommendations from the Data Protection Authority in Belgium, guidelines, recommendations, and best practices of the European Data Protection Board, or court decisions.
Balnz encourages You to regularly consult this Privacy Policy and to refer to the date of the latest modification.
11. Validity of the Policy’s Provisions
The invalidity or unenforceability of (a part of) any provision shall not affect the validity of the remaining provisions. The invalid provision will be deemed unwritten and replaced by a valid provision pursuing, to the extent possible, the same objective.
12. Governing Law and Jurisdiction
The validity, interpretation, and execution of this Policy are governed by Belgian law, to the extent permitted by applicable private international law.
In case of disputes regarding the validity, interpretation, or execution of this Policy, the French-speaking courts of the judicial district of Brussels shall have exclusive jurisdiction, to the extent permitted by applicable private international law.
Before initiating legal proceedings, Balnz and You agree to attempt to resolve the dispute amicably, possibly through mediation, arbitration, or any other form of alternative dispute resolution.
