1. Introduction

The Balnz application (the "Application") is managed and operated under the responsibility of:

The Application includes all products, features, applications, services, technologies, and software provided by Balnz to fulfill its mission: motivating users to find their digital balance.

The Application includes the following services:

Tracking users’ active screen time on their smartphones;
Suggesting challenges to reduce screen time on smartphones;
Rewarding children who successfully complete the suggested challenges;
Offering personalized opportunities to reward children who complete the challenges;
Sharing the results of completed challenges;
To be completed if necessary.

Any questions or complaints regarding the Application or these Terms of Use (the "Terms") should be addressed to Balnz at the address above or via email: privacy@balnz.io.

2. Acceptance of the Terms

Access to the Application is subject to these Terms and applicable regulations. Accessing the Application implies full and unconditional acceptance of these Terms by the user (the "User").

The Terms are available at any time within the Application and on the website www.balnz.io.

3. Accessibility and Functionality of the Application

Balnz strives to keep the Application up-to-date and accessible to a normal number of Users. However, Balnz does not guarantee that the Application’s functions will be uninterrupted or error-free, that defects will be corrected immediately, or that the server providing the Application is free of viruses or other harmful components.

Balnz cannot be held liable for any loss or damage of any kind resulting from the suspension, interruption, disruption, slowdown, or termination of access to all or part of the Application, or from viruses present in the Application.

If the User detects an error, virus, or other harmful elements in the Application, they are invited to notify Balnz at info@balnz.io so that appropriate measures can be taken. In any case, Balnz advises Users to install firewalls, antivirus programs, and other necessary protection software on their devices to prevent potential damage.

Balnz reserves the right to suspend or discontinue all or part of the Application at any time, without justification and without prior notice.

4. Age and Use of the Application

To use the Application, the User must (i.) be 13 years of age or older, or have parental or guardian consent if under 13, and (ii.) reside in Belgium. The User also guarantees that all information provided to Balnz during registration is truthful, accurate, and complete, and agrees to keep it up-to-date.

If the User is under 13, a parent or guardian must accept these Terms on their behalf and authorize the processing of their personal data through the Application, in accordance with applicable data protection regulations and the Balnz Privacy Policy available here. If the User does not meet the minimum age requirement, Balnz will not be able to register them on the Application.

The User agrees to use the Application solely for its intended purpose and not for any other use.

The User is responsible for ensuring that all information they provide is accurate and current.

The User agrees to use the Application in good faith and in compliance with applicable laws, and in particular not to:

send false or misleading content or communications to Balnz (and update it if necessary to ensure it remains accurate);
provide email addresses or other content to Balnz without obtaining prior consent from the individuals concerned;
send content to Balnz that infringes the rights of third parties (intellectual property, privacy, trade secrets, etc.);
send content that links to illegal or inappropriate websites;
use the Application for sending spam, unsolicited emails, pyramid schemes, or similar fraudulent processes;
perform any action that could disrupt the proper functioning of the Application, including the use of worms, viruses, mail bombs, or mass mailings;
attempt to gain unauthorized access to any part of the Application or to equipment used to operate the Application;
use a false name, pseudonym, or impersonate another person or entity;
use the Application for purposes other than those provided for in these Terms.

Balnz cannot be held liable for any non-compliance by the User with these Terms and/or applicable laws or regulations. The User indemnifies Balnz against any claim or complaint from third parties (including public authorities) related to their use of the Application.

The User uses the Application at their own risk. The Application, its components, and all related information, software, installations, and services are provided "as is", as available, without any warranty of any kind (express or implied) and to the extent permitted by applicable law.

Balnz disclaims all liability for any loss or damage (direct, indirect, material, or immaterial) resulting from the use of the Application and its components, or the inability to use the Application.

The User is also required to immediately inform Balnz in writing if they become aware of any inappropriate behavior or use related to the Application by sending an email to privacy@balnz.io.

5. Links to Other Websites

Hyperlinks to other websites may be included in the Application. Similarly, certain websites may include a link to the Application. These third-party sites are not controlled by Balnz, which therefore assumes no responsibility for their operation, content, or use. Unless expressly stated otherwise by Balnz in the Application, the existence of such links does not imply any approval by Balnz of these third-party sites or their use, nor any association or partnership with the operators of these sites.

6. Intellectual Property Rights

The Application and its components (brands, logos, graphics, photos, animations, videos, music, texts, etc.) are the property of Balnz. They are protected by intellectual property rights (including copyrights, design rights, trademark rights) and may not be reproduced, used, or distributed without prior written authorization from Balnz or, where applicable, the relevant rights holder, under penalty of infringement.

Balnz grants the User a non-exclusive, non-transferable, indefinite, and revocable license at any time without justification, to access, display, and download the content of the Application solely for viewing purposes. The User may also print a copy of the content displayed in the Application for personal use, provided that the content is not altered and all ownership notices and origin references are retained. Reproduction is therefore only permitted for strictly private use within the meaning of Article XI.190.5° of the Belgian Code of Economic Law.

Any use of the Application and its components not covered by this article is strictly prohibited.

7. Complaints

To be valid, any complaint from the User regarding the Application must be submitted in writing within eight (8) calendar days from becoming aware of the fact giving rise to the complaint. Failure to comply with these rules implies unconditional acceptance of the fact and final waiver of any complaint in this regard.

8. Validity of the Terms

Balnz's failure to invoke a provision of these Terms at any given time shall not be interpreted as a waiver of its rights to invoke it later.

The invalidity or unenforceability of (a part of) any provision shall not affect the validity of the remaining provisions. The invalid or unenforceable provision will be considered unwritten and replaced by a valid provision pursuing, to the extent possible, the same objective.

9. Governing Law and Jurisdiction

The validity, interpretation, and/or execution of these Terms are governed by Belgian law, to the extent permitted by applicable private international law rules.

In case of disputes relating to the validity, interpretation, or execution of these Terms, the Courts and Tribunals of the judicial district of Brussels shall have exclusive jurisdiction, to the extent permitted by applicable private international law rules.

Before taking any legal action, the User and Balnz agree to attempt to resolve the dispute amicably. To this end, they will first contact each other, before resorting, if necessary, to mediation, arbitration, or any other alternative dispute resolution method.
