1. About this Policy

Balnz ("Balnz") is committed to respecting the privacy of individuals whose personal data it processes (children, parents, etc.) and to treating such data with the utmost confidentiality and in compliance with applicable laws, including Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the "General Data Protection Regulation" or "GDPR"), as well as the Belgian law of July 30, 2018 on the protection of individuals with regard to the processing of personal data (together, the "Law").

 

This privacy policy (the "Policy") aims to transparently inform teenagers aged 13 and over ("You") when they use the Balnz application, about the personal data Balnz collects, the purpose of the collection, how Balnz uses the personal data, and the rights You can exercise regarding the processing of this data.

 

2. Data Controller of Your Personal Data

 

Balnz is the data controller of Your personal data when You use the Balnz application:

Balnz has appointed a dedicated representative as a single point of contact for the protection of Your personal data. You can contact them at any time with questions: privacy@balnz.io.

 

3. Personal Data Collected and Processed

 

Balnz processes the following personal data about You:

  • Your first and last name;

  • Your username;

  • Your phone number;

  • Your date of birth;

  • Your gender;

  • Any questions, comments, and/or feedback You provide in the Balnz app sections;

  • Your activity time in the Balnz app;

  • Your profile picture or avatar when using the Balnz app;

  • Your results and rewards within the Balnz app;

  • Your interests and preferences when You enter them in the Balnz app;

  • Your friends who also use the Balnz app;

  • If Your parents registered You in the Balnz app: Your parents' contact information.

 

Apart from these types of personal data, Balnz does not collect or store any other personal data about You. Specifically, Balnz tracks Your screen time on Your smartphone but does not collect any information about the content You view or Your communications outside the Balnz app. This means Balnz has no visibility into what You do or who You communicate with outside of Balnz, such as on websites, social networks, etc.

4. Purposes and Legal Grounds for Processing Your Personal Data

 

Balnz collects and processes Your personal data in order to:

  • Manage Your registration in the Balnz app;

  • Ensure Your access to the Balnz app;

  • Suggest challenges to help You manage Your screen time;

  • Track Your screen time on Your smartphone;

  • Award You with rewards when You complete challenges within the Balnz app;

  • Respond to Your requests and/or questions;

  • Enable You to share and communicate within the Balnz community (e.g., Your results);

  • Comply with legal obligations applicable to Balnz;

  • Improve the application and services provided by Balnz;

  • Pursue Balnz’s legitimate interests, provided they align with and do not infringe upon Your fundamental rights and freedoms.

 

The legal grounds for processing Your personal data are:

  • Your consent;

  • Compliance with a legal obligation applicable to Balnz;

  • Balnz’s legitimate interests, provided they do not override Your fundamental rights and freedoms.

 

5. Retention Period of Your Personal Data

 

Balnz retains Your personal data only for as long as necessary to fulfill the purposes outlined above. In certain cases, Balnz may retain Your personal data longer, for example, to respond to Your questions or complaints or to comply with its legal obligations.

 

To improve the Balnz app, Balnz may compile statistics based on Your personal data. In such cases, Balnz ensures that Your personal data is anonymized so You cannot be identified in the statistics produced.

6. Your Rights

 

As provided by the Law, You have the right to ask Balnz to:

  • Inform You about how Your personal data is processed when You use the Balnz app;

  • Give You access to Your personal data;

  • Correct or update Your personal data in the Balnz app;

  • Object to Balnz processing Your personal data;

  • Delete Your personal data from the Balnz app;

  • Restrict the processing of Your personal data;

  • Transfer Your data to another application (data portability);

  • File a complaint with the Belgian Data Protection Authority online: www.dataprotectionauthority.be or via email: contact@apd-gba.be.

 

To exercise these rights, Balnz asks You to send a written request to: privacy@balnz.io.

 

7. Sharing Your Personal Data with Third Parties

 

Balnz treats Your personal data as confidential information. Balnz does not share Your personal data with third parties unless this is provided for in this Policy, necessary to achieve the purposes outlined above, or required by law.

 

8. Transfer of Your Personal Data Outside the European Union

 

Balnz does not transfer Your personal data outside the European Union.

 

If such a transfer becomes necessary, Balnz commits to ensuring that the destination country offers an adequate level of data protection in compliance with the Law.

 

9. Security of Your Personal Data

 

Balnz takes appropriate security measures to ensure a sufficient level of security for Your data in the Balnz app, for example, to prevent:

  • Unauthorized access to Your personal data;

  • Unauthorized modification of Your personal data;

  • Misuse of Your personal data;

  • Disclosure of Your personal data;

  • Destruction or accidental loss of Your personal data.

 

10. Updates to this Policy

 

Balnz may modify or update this Policy, for example, to comply with new laws on personal data processing. In such cases, Balnz will inform You and/or Your parents of any changes so You can review them.
